What Blood Alcohol Level is Over the Limit?
This is one of the most commonly asked questions we hear at
James Head Law. What’s important to realize is that BAC levels vary from state to state. In the State of Georgia the BAC limit for a driver is .08. That means that if your BAC is over.08 then you can be charged with a drunk driving offense.
There are also other limits to keep in mind for the State of Georgia. For drivers under 21 years of age, it’s possible to be charged with a drunk driving offense with a BAC of .02; substantially less than those over the age of 21. Georgia also carries heavier penalties for those with a BAC of .15 or more.
For most DUI offenses, BAC is measured through a breath testing machine called a Breathalyzer. This is the common tool for measuring drivers suspected to be under the influence of alcohol. It’s also possible for blood and urine samples to be used to measure BAC levels, but this method obviously involves more work and cooperation from those involved. These tests also take time to process delaying the time frame between the incident and when the results are given.
